Special Marriage Act timeline: when to arrive, give notice and marry

Two months in India, in the right order. Working back from your date, the tool gives you the day to land, the day to file notice and the day you can marry.

How it works

Choose the day you want to marry before the Marriage Officer. Under the Special Marriage Act, 1954, one of you must have lived in that district for 30 days before giving notice, anyone may object for 30 days after the notice is published, and the marriage must happen within 3 months of the notice, in front of 3 witnesses. The tool turns those rules into dates and a calendar file. Because the stay is about two months, most couples from abroad marry legally at home and hold their ceremony in India.

About 60 days in India from arrival to the marriage, and the notice can be given no earlier than 20 November 2026.

  1. Arrive and start living in the district

    At least one of you lives in the district of the Marriage Officer for 30 days before notice is given. Keep proof of address from day one.

  2. Give notice of intended marriage

    File the notice with the Marriage Officer, who publishes it. This is the latest day that still allows the waiting period before your date.

  3. Objection period ends

    Anyone may object within 30 days of the notice being published.

  4. Marry before the Marriage Officer

    With 3 witnesses, after the waiting period and within 3 months of the notice. The marriage is registered the same day.

Requirements vary between offices; confirm the list with the Marriage Officer before you travel.

  • Passports and valid Indian visas
  • Proof of address in the district for the 30 days (for example, a letter from your hotel or landlord)
  • Birth certificates and passport photographs
  • A sworn statement of age and marital status
  • If previously married, a divorce decree or a death certificate
  • For foreign nationals, often a certificate of no impediment or single status from your embassy

Marry legally at home instead?

Most of our couples from abroad do. You sign the papers at a registry office or courthouse in your own country, before or after the trip, and the ceremony in India is the wedding everyone remembers. It is simple, fast and recognised at home without any extra steps. The ceremony looks the same either way: the same vows, the same guests, the same party.

Questions couples ask

How long do we need to stay in India to marry under the Special Marriage Act?

Plan for about two months: 30 days of residence in the district before the notice, and a 30-day notice period before the marriage can be solemnised.

Can the ceremony be on a different day from the registration?

Yes. The registration is a short appointment with the Marriage Officer and three witnesses. Many couples hold their ceremony and celebration in the days after.

Do both of us need to live in the district for 30 days?

At least one partner must. Keep proof of address from the first day, such as a letter from your hotel or landlord.

What happens if someone objects to the notice?

The Marriage Officer looks into the objection before deciding whether the marriage can go ahead. Objections are rare, but they are the reason for the 30-day period.

Does a marriage under the Special Marriage Act count at home?

Usually, but recognition depends on your own country’s rules. Check with your embassy, consulate or a family lawyer before relying on an Indian certificate.
